6 Week Suspension

Postby maddog1971 » Tue Jan 22, 2019 5:50 pm

Had this discussion the other night at a game. The debate was this.
So a student gets caught with alcohol/tobacco/drugs or are even guilt by association (which is wrong) get suspended for 6 weeks. Next time they get caught 18 weeks.... next time life. So If a kid gives a drunk friend a ride home and they get stopped, the sober driver goes down as well.
Now kids that have committed a major law offense like stealing a car, assault, theft, fraud, sex crimes or domestic abuse does not receive any type of punishment unless it involves drugs or alcohol? Is that right? It can not be. Someone clear this up for me.

If they haven't been drinking and there is no booze in vehicle, nothing to worry about.

There is no life ban for third offense. Also at the end of every school year, the suspensions are done and start anew the following August.

"SECTION XI: The use or possession of tobacco, alcohol, or any controlled substance as defined by
North Dakota Law is prohibited. Any student who is in violation of the foregoing shall be suspended
from participation in interscholastic contests or activities for a minimum period of six consecutive
school weeks for the first offense and a period of 18 consecutive school weeks for any subsequent
offense."

"Art XIV - Sec XI: 4.
Q: If the suspension period runs into Christmas vacation, is the period extended by an
amount equal to the length of said vacation?
A: No, the suspension period is for 6 calendar weeks of the school term from the date of
suspension.
Art XIV - Sec XI: 5.
Q: If the violation occurs two weeks before school is out in the spring, does the
suspension carry over for the next school year?
A: No, however the suspension remains in effect until the end of the spring activity
season"

Building off last response with the NDHSAA ByLaws from the NDHSAA website; also to note...each school district is allowed to have stricter policies. 6 weeks (first offense) & 18 weeks (second offense and consequent offenses) are minimum penalties handed out by the NDHSAA

Ok.... I guess it is our school's rules about the association rule and the lifetime suspension.

But shouldn't there be something on the books about crime as well? Basically that is my point.

Many schools have a criminal acts policy as well that includes a suspension.

Our school policy reads that if a student is caught during the summer (say at the Fair) their suspension starts the first day of practice for fall sports. A student can practice but unable to play for 8 weeks. (I believe we do 8 week suspensions vs 6 week.)

Many schools have that summer policy. At our school the suspension is 6 consecutive school weeks. If a student has a violation with 2 weeks of school left in May, the suspension carries over into the fall with the start of the first practice if they are in a sport or the first day of school if they are not. Summer violations are treated the same way.
